본 연구의 목적은 우리나라 ‘고용상 연령차별 금지 및 고령자 고용촉진법’이 고령자 고용촉진, 고령자 노동권 보호 그리고 사회통합에 어떠한 역할을 할 수 있는지에 대해 관련법을 살펴보고, 우리나라 고용상 연령차별 금지 및 고령자 고용촉진법이 나아가야 할 방안을 제시하는 것이다. 이를 위해 차별 금지법 중 연령에 대한 부분을 별도로 법제화 하여 실행 하고 있는 두 국가, 미국과 네덜란드의 연령차별 금지법을 우리나라 연령차별 금지법의 조항들과 함께 분석하였다. 비교분석틀은 각국의 연령차별 금지법의 시행 배경, 연령차별에 대한 개념 범위, 연령차별 금지법 적용대상 그리고 연령차별 금지법의 예외규정들에 대한 내용으로 구성되어 졌다. 분석결과 미국과 네덜란드의 연령차별금지법은 우리나라 연령차별 금지법 발전 방안에 세 가지 함의를 제시해 주었다. 첫째, 연령차별 금지법상의 연령차별 개념이 괴롭힘의 개념까지를 포함할 수 있는 넓은 개념이 되어야 할 것이다. 둘째, 정년 명시 폐지를 목표로 하여 점차적으로 정년연령을 연금 수령연령과 맞추어 늘려가야 할 것이다. 마지막으로 연령차별 금지법 예외규정들에 대한 명확한 한계성을 제시할 필요가 있다.;The purpose of this study was to examine legal provisions of ‘Age Discrimination in Employment and Aged Employment Promotion Act’ in Korea and to suggest directions for improvement of this Act. For this purpose, legal provisions of age discrimination acts of three countries including Korea were analyzed and examined. As is the case in Korea, the US and the Netherlands have in place age discrimination act separately from other anti-discrimination laws. The analysis tool of this study was composed around four questions: what is historical background of age discrimination act; does each country’s age discrimination act include the four concepts of age discrimination; who are protected by age discrimination act; and what are the exemptions from age discrimination act. Major findings of this study are: first, the definition of age discrimination in the Act should include ‘harrassment’; second, with the goal of abolishing retirement age over time, retirement age should be adjusted upward to pensionable age, and; lastly, there should be a clear specification of the scope of the existing exemptions from age discrimination.
This study aims to investigate the effect of elderly stigma on depression, with the mediating role of aging anxiety on middle-aged and older adults, and to provide practical implications mitigating the depression of middle-aged and older adults. Respondents include 590 middle-aged and older adults from 'Survey on Age Integration', conducted on behalf of Initiative for Humanities' Research and Education with funding from National Research Foundation of Korea, and the analysis was done using SPSS PROCESS macro. The results indicate significant indirect effect of aging anxiety in the relationship between elderly stigma and depression, but the direct effect from elderly stigma to depression was not found to be significant. The result demonstrates the role of aging anxiety in the relationship between negative perception of the elderly and depression among middle-aged and older adults. Therefore, social welfare means to decrease and prevent aging anxiety are required. Based on the results, the study suggests developing programs of old age preparation and aging adaptation, and building practical social support network that can stabilize life in old age as specific means to prevent aging anxiety. Furthermore, intergenerational exchanges that can reduce elderly stigma are also discussed.
본 연구는 중고령자의 노인 낙인이 노화불안을 경유하여 우울에 미치는 영향을 살펴보는 것으로, 중고령자의 우울감소를 위한 실천적 함의를 제공하는 것을 목적으로 하였다. 이를 위해 한국연구재단의 지원을 받아 수행된 ‘2018년 연령통합 및 세대통합조사’ 자료의 45세 이상 중고령자 590명을 대상으로 분석였으며, SPSS PROCESS macro를 활용하여 매개효과를 분석하였다. 분석결과 노인낙인과 우울의 관계에서 노화불안의 간접효과가 유의미한 것으로 나타난 반면, 노인낙인이 우울에 미치는 직접적인 영향을 유의미하지 않는 것으로 나타났다. 이러한 연구결과에서 볼 때, 중고령자의 노인에 대한 부정적 인식이 우울에 미치는 영향에 노인낙인의 역할이 중요함을 알 수 있다. 따라서 노화불안 감소와 예방을 위한 사회복지적 지원의 필요성이 요구된다. 이에 본 연구에서는 노화불안 예방을 위한 구체적 방안으로 노년기 준비 및 노화적응을 위한 프로그램 개발과 노후의 삶의 안정을 위한 실제적 사회 안전망 구축 등의 방안을 제언하였다. 더불어 노인낙인을 감소하기 위한 연령교류의 방안에 대해서도 함께 논의하였다.
